Voice Cloning Service Terms of Use

These Voice Cloning Terms of Use ("Terms") apply to the voice cloning features of SpeechGen.io ("Service", "we", "us"). They supplement the main Terms of Service and Privacy Policy.
By creating, storing, or using a voice clone you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the voice cloning feature.
1. Eligibility
1.1. You must be at least 18 years old to create a voice clone. Voice cloning is not available to minors, regardless of parental consent.
1.2. You must have the legal capacity to enter into a binding agreement in your jurisdiction.
1.3. You are responsible for compliance with all applicable laws in every jurisdiction where you create, store, distribute, or use cloned voice content — including data protection, privacy, publicity rights, intellectual property, consumer protection, and election laws.
2. Voice ownership and consent
2.1. Your own voice
You may clone your own voice. By uploading audio, you confirm that you are the sole speaker in the recording and that you control the rights to that recording.
2.2. Third-party voices
To clone a voice that is not your own, you must first obtain explicit, informed, documented written consent from the person whose voice is being cloned. The consent must:
- be freely given, specific, and informed;
- identify SpeechGen as the processing platform;
- cover both the creation of the voice model and its use for generating synthesized speech;
- state the intended purpose and scope of use;
- be retained by you for as long as the clone exists and for at least two (2) years after deletion.
Consent may be withdrawn by the speaker at any time. Upon withdrawal, you must delete the voice clone immediately.
2.3. Proof of consent
SpeechGen may request documentation of consent at any time. Failure to produce valid documentation within seven (7) days of our request will result in permanent deletion of the voice clone and may result in termination of your account.
2.4. Voices of minors
Strict prohibition. Voices of persons under 18 years old must never be uploaded or cloned, regardless of parental or guardian consent.
2.5. Restricted categories
You may not clone the voices of:
- sitting heads of state, senior government officials, judges, or candidates during any active election period;
- deceased persons, unless you provide documented estate authorization;
- public figures where cloning could reasonably be perceived as endorsement, impersonation, or defamation;
- law enforcement, military, or emergency-services personnel in a manner that implies official communication.
3. Prohibited uses
You may not use voice cloning, or distribute content generated with it, to create, store, or share audio that:
3.1. Impersonation and fraud
Impersonates any real person, misrepresents identity or affiliation, or creates a false impression of authenticity. Includes voice phishing, vishing, social-engineering attacks, or any fraudulent scheme.
3.2. Deepfakes and deception
Produces synthetic audio intended to deceive listeners into believing that the depicted speaker said something they did not say, where such audio causes or is reasonably likely to cause harm, mislead public opinion, or influence an election, referendum, or public-policy decision.
3.3. Non-consensual sexual content
Generates audio of a sexual, pornographic, or sexually suggestive nature that depicts any identifiable person without their prior explicit written consent.
3.4. Content involving minors
Generates any sexual, exploitative, grooming, or otherwise inappropriate content involving or depicting persons under 18 years old. This includes child sexual abuse material (CSAM), content that sexualizes minors, and content that endangers children in any way.
3.5. Harassment, threats, and hate
Targets individuals or groups with harassment, stalking, doxxing, threats of violence, blackmail, hate speech, discrimination, or incitement to violence against any protected characteristic or class.
3.6. Illegal activity
Promotes, plans, or facilitates any activity prohibited by applicable law, including — without limitation — terrorism, violent extremism, incitement to crime, illegal drug or weapons trafficking, human trafficking, or circumvention of sanctions.
3.7. Election interference and political deception
Creates audio that falsely attributes statements to political candidates, election officials, public authorities, or government representatives, particularly during an active election period. This includes but is not limited to the deceptive use regulated by the EU AI Act, California AB 2655 and AB 2839, and similar laws worldwide.
3.8. Defamation
Creates audio designed to damage a person's or organization's reputation through false or misleading statements.
3.9. Intellectual-property violations
Reproduces voices or performances protected by publicity rights, personality rights, trademark, or existing commercial voice-over contracts without proper authorization.
3.10. Training competing models
Uses audio generated by the Service to train, fine-tune, benchmark, or otherwise improve any third-party voice synthesis model, deepfake-detection model, or competing product or service.
3.11. Reverse engineering
Attempts to extract model weights, training data, proprietary algorithms, or other technical internals of the Service by any means.
3.12. Reselling and redistribution
Sells, licenses, sublicenses, or redistributes SpeechGen-built-in voices or voice models as a standalone product.
4. Disclosure of synthetic audio
4.1. Where required by applicable law — including the EU AI Act, California AB 2655 and AB 2839, comparable US state laws, and similar regulations worldwide — you must clearly and conspicuously disclose that the audio is AI-generated.
4.2. If your cloned voice is used in a conversational agent (IVR, voicebot, virtual assistant) that interacts with a human in real time, you must disclose that the interaction is with an AI, as required by law in the jurisdiction of the interaction.
4.3. Good-faith disclosure practices include audible voice-over labels, visible on-screen indicators, metadata signatures (e.g. C2PA / Content Authenticity Initiative), or written disclaimers in the content description.
5. User responsibilities and warranties
By using the Service, you represent and warrant that:
- you have the full legal right, title, and all necessary consents to upload, process, and generate content using every audio sample you submit;
- all content you create using the Service complies with every applicable law in every jurisdiction where it will be accessed, used, or distributed;
- you will not cause SpeechGen, its affiliates, employees, or other users to violate any law through your use of the Service;
- you will maintain the security of your account credentials and are responsible for all activity under your account.
5.1. Indemnification. You agree to defend, indemnify, and hold harmless SpeechGen, its owners, officers, employees, contractors, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- any content you upload, create, generate, distribute, or derive using the Service;
- any voice model you build, including unauthorized use of a third-party voice;
- any violation of these Terms by you;
- any violation by you of applicable law or the rights of any third party (including privacy, publicity, and intellectual-property rights).
6. Privacy and data handling
6.1. Private by default. Voice models you create are visible and accessible only to your account. They are not included in any public catalog, marketplace, or shared library, and are not accessible to other users.
6.2. No third-party sharing. Audio samples and voice models are not sold, traded, or shared with third parties, except as required by court order, law-enforcement subpoena, or other binding legal process in any jurisdiction where we operate.
6.3. Processing location. Audio samples and voice models may be processed on servers located in any jurisdiction selected by SpeechGen. By using the Service you consent to such cross-border processing.
6.4. Deletion. You may delete a voice clone at any time through your account settings. Deletion is permanent and non-recoverable. The voice model is removed from all active production systems within 30 days of the deletion request; residual backup copies are purged under our standard rotation.
6.5. Account closure. When you close your SpeechGen account, all associated voice models and training samples are deleted automatically under the same timelines.

7. Intellectual property
7.1. Your content. You retain ownership of the audio samples you upload and of the synthesized audio produced using your voice model, subject to the license in 7.2.
7.2. License to SpeechGen. You grant SpeechGen a limited, non-exclusive, royalty-free, worldwide license to store, process, reproduce, and transmit your audio samples and voice models solely for the purpose of operating the Service for you — including building, storing, running, and improving your voice model and generating your output. This license terminates automatically when you delete the clone or close your account.
7.3. SpeechGen technology. SpeechGen retains full ownership of all underlying models, algorithms, software, infrastructure, user interface, and built-in voices. Nothing in these Terms transfers any ownership or license to that technology other than the limited access granted to use the Service.
8. Enforcement, suspension, and termination
8.1. Monitoring. SpeechGen may monitor voice-cloning activity, including through automated systems, to detect abuse and enforce these Terms.
8.2. Suspension. We may suspend your access to voice cloning features at any time, with or without notice, if we reasonably suspect a breach of these Terms or if suspension is necessary to protect other users, third parties, or SpeechGen.
8.3. Termination. Material breach — including creating content prohibited under Section 3, uploading voices without valid consent, or attempting to circumvent restrictions — will result in immediate termination of your SpeechGen account and permanent deletion of all voice models and generated content stored under your account.
8.4. No refunds. No refunds of credits, subscriptions, or storage fees will be issued for accounts terminated for breach of these Terms.
8.5. Reporting to authorities. SpeechGen cooperates with law enforcement worldwide and may report suspected illegal activity to competent authorities in the jurisdictions where such activity occurred.
9. Abuse reports and takedown
9.1. Reporting misuse. If you believe a voice clone has been created or used in violation of these Terms — including unauthorized cloning of your own voice — report to admin@speechgen.io.
9.2. Information to include. Describe the alleged violation; provide URLs, user identifiers, or other identifying information; attach proof where available; include your contact details.
9.3. Copyright / DMCA. Claims of copyright infringement should be directed to admin@speechgen.io and must include the information required by 17 U.S.C. § 512(c)(3). Repeat infringers will have their accounts terminated. Knowing misrepresentation in a DMCA notice may result in liability for damages under 17 U.S.C. § 512(f).
9.4. Response. We review reports in good faith and act on valid claims promptly, including removing content, deleting voice models, and suspending or terminating accounts.
10. Disclaimers
10.1. "As is" service. The voice cloning feature is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
10.2. No verification of content. SpeechGen does not pre-verify uploaded audio, user identity, the authenticity of claimed consent, or the lawfulness of the intended use. The entire responsibility for the legality of uploaded and generated content rests with the user.
10.3. No guarantees on output. We make no guarantee that any voice clone will meet a particular quality standard, perfectly replicate the source speaker, or be suitable for any specific purpose. Output quality depends on sample quality, language, speaker characteristics, and other factors beyond our control.
11. Limitation of liability
11.1. To the maximum extent permitted by applicable law, SpeechGen's aggregate liability under or in connection with these Terms is limited to the amount you actually paid to SpeechGen for voice cloning in the twelve (12) months preceding the event giving rise to the claim, or USD 100, whichever is greater.
11.2. To the maximum extent permitted by law, SpeechGen is not liable for indirect, incidental, consequential, punitive, exemplary, or special damages, or for lost profits, lost data, loss of business, or loss of goodwill arising from or related to your use of the Service — whether based on warranty, contract, tort (including negligence), or any other legal theory.
11.3. Nothing in these Terms limits liability that cannot lawfully be limited under the mandatory consumer-protection law of your jurisdiction.
12. Governing law and jurisdiction
12.1. These Terms are governed by the laws identified in the main SpeechGen Terms of Service.
12.2. Any dispute arising out of or relating to these Terms will first be addressed through good-faith negotiation. If negotiation fails, disputes will be resolved under the dispute-resolution mechanism stated in the main Terms of Service — including arbitration and venue where applicable.
13. Changes to these Terms
13.1. We may update these Terms from time to time. Material changes will be communicated through the Service or by email to the address associated with your account at least fourteen (14) days before taking effect. Continued use of voice cloning after the effective date constitutes acceptance of the revised Terms.
